These Terms of Use (“Terms”) govern your access to and use of the Services. By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be able to form a binding contract under applicable law to use the Services. Contests and giveaways may impose additional age, residency, and eligibility rules in their Official Rules.

2. The Services

We provide media, newsletter, contest, and related digital experiences. Features may change, suspend, or end at any time. We do not guarantee uninterrupted or error-free operation.

3. Accounts and subscriptions

If you subscribe by email or create an account with a platform we use (e.g., Beehiiv), you are responsible for providing accurate information and for activity under your credentials. You may unsubscribe from marketing email as described in the Privacy Policy.

4. Contests and promotions

Contest entry pages (including on `contests.thebacklabel.com`) may embed third-party contest technology (e.g., DojoMojo). Each promotion is governed by its Official Rules. If these Terms conflict with Official Rules on prize or eligibility matters, the Official Rules control for that promotion. Unless Official Rules say otherwise, no purchase is necessary to enter or win, and a purchase does not improve chances of winning.

5. Acceptable use

You agree not to:

Violate law or third-party rights
Interfere with or disrupt the Services, security, or other users
Scrape, harvest, or automate access in a way that burdens our systems (except as allowed by robots.txt or written permission)
Submit unlawful, infringing, or deceptive content
Attempt to bypass consent, paywall, or access controls

We may suspend or terminate access for violations.

6. Intellectual property

The Services—including text, graphics, logos, and compilation—are owned by us or our licensors and protected by intellectual property laws. You receive a limited, revocable, non-exclusive license to access the Services for personal, non-commercial use unless we agree otherwise in writing. Brand names and marks of thebacklabel and third parties remain their respective owners’ property.

7. Third-party services, ads, and affiliates

The Services may include third-party embeds, links, advertising (including via Ezoic and other partners), and affiliate or sponsored relationships. We are not responsible for third-party content, policies, or practices. Your dealings with advertisers, booking providers, and prize partners are between you and that third party.

Where we use affiliate links, sponsorships, gifted travel, or similar commercial relationships, we aim to disclose them in a manner consistent with applicable advertising rules (including FTC endorsement guidance). Editorial positioning of thebacklabel does not waive those disclosure obligations.

8. Privacy and data

The Privacy Policy explains that we may sell, share, and commercially use personal information in connection with advertising and related businesses, subject to applicable law and opt-out rights (Your Privacy Choices).

Ingredients, allergens, availability, and safety practices vary. Verify labels and use your own judgment. We are not responsible for outcomes from following recipes or recommendations.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING CERTAIN PRIVACY OR CONSUMER STATUTORY CLAIMS).

11. Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms, to the extent permitted by law.

12. Governing law

Ecommerce Advisors LLC is organized under Delaware law. These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Courts located in Delaware shall have exclusive jurisdiction for disputes arising from these Terms, subject to those mandatory protections and any non-waivable rights you have to bring claims in your home jurisdiction.

13. Changes

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
